Please read these Terms and Conditions carefully before purchasing or participating in Dr. Kimberley's Metabolic Reset (the "Program"). By completing your purchase, you confirm that you have read, understood, and agree to be bound by these terms.

These terms form an agreement between you (the "participant," "you," or "your") and Kimberley O'Brien, operating as Dr. Kimberley O'Brien, ND (the "Program provider," "we," "us," or "our").

1. About the Program

Dr. Kimberley's Metabolic Reset is an eight-week live group education program. It includes weekly live group calls, educational materials, frameworks, and access to program recordings and resources for the period stated at the time of purchase.

The Program is educational in nature. It is designed to teach you about metabolism, hormones, nutrition, inflammation, and related topics, and to help you work through a structured framework. It is delivered to a group. It is not individualized care, and it is not a substitute for the advice of your own healthcare provider.

2. Medical Disclaimer

This is the most important section of these terms. Please read it carefully.

Although Kimberley O'Brien holds a Doctor of Naturopathic Medicine credential, she is not providing naturopathic medical care, diagnosis, or treatment through this Program. The Program is educational and informational only.

By participating, you understand and agree that:

• The Program does not create a doctor-patient, practitioner-client, or any other clinical or therapeutic relationship between you and Kimberley O'Brien.
• Nothing in the Program is medical advice, diagnosis, or treatment. It is general education delivered to a group and is not tailored to your individual medical situation.
• You should not start, stop, or change any medication, supplement, treatment, or medical care based on Program content without first consulting your own qualified healthcare provider.
• You are responsible for your own health decisions. Before making changes to your diet, exercise, supplement routine, or lifestyle, you should consult your physician or a qualified healthcare provider, particularly if you are pregnant, nursing, taking medication, or living with a medical condition.
• The Program is not appropriate for medical emergencies. If you are experiencing a medical emergency, contact your local emergency services immediately.

The information shared is believed to be accurate and is offered in good faith, but it is provided without warranty of any kind. Individual results vary, and no specific outcome is promised or guaranteed.

3. Former Patients

If you were previously a patient of Kimberley O'Brien's naturopathic practice, please note that your participation in this Program is separate from, and does not continue, any past clinical relationship. That relationship ended when the practice closed.

In this Program, Kimberley is not acting as your naturopathic doctor and is not reviewing, relying on, or taking into account your personal medical history, prior records, lab results, or any care you received as a patient. The Program is general group education, the same for every participant, and nothing in it is tailored to your individual medical situation. For anything specific to your own health or history, please consult your current healthcare provider.

4. No Guarantee of Results

Health is individual. Your results depend on many factors, including your starting point, your participation, your circumstances, and factors outside anyone's control. We do not promise or guarantee any specific result, including any change in weight, energy, symptoms, lab values, or wellbeing. Any examples or outcomes referenced in our materials are illustrative and are not a promise of what you will experience.

5. Payment

The price of the Program is stated at the time of purchase in Canadian dollars (CAD) unless otherwise noted. Applicable taxes are added at checkout. By purchasing, you authorize us to charge the payment method you provide for the full amount, including any applicable taxes.

6. All Sales Are Final

Because this is a live program with limited spots and immediate access to educational content and materials, all sales are final. We do not offer refunds once your purchase is complete and you have been granted access to the Program.

We want you to enroll with clarity. Before purchasing, please make sure the Program is right for you, that the dates and time commitment work for your schedule, and that you understand what is and is not included. If you have questions about whether the Program is a good fit, contact us before you buy.

If you are unable to attend live calls, recordings are provided so you can participate on your own schedule within the access period. Missing live calls does not entitle you to a refund.

In the rare event that we cancel the Program before it begins, you will receive a full refund of amounts paid.

7. Your Participation and Conduct

The Program is a group environment. To keep it a respectful and productive space for everyone, you agree to:

• Treat the facilitator and other participants with respect.
• Maintain the privacy of other participants. What is shared in the group stays in the group. You may not record, share, screenshot, or distribute other participants' personal information or contributions.
• Refrain from disruptive, abusive, harassing, or inappropriate behaviour.

We reserve the right to remove any participant whose conduct is disruptive or harmful to the group, without refund.

8. Intellectual Property

All Program content, including videos, recordings, written materials, frameworks, worksheets, recipes, guides, and the underlying methods and concepts, is the intellectual property of Kimberley O'Brien and is protected by copyright. It is provided to you for your personal use only.

You may not copy, reproduce, distribute, resell, share, publish, or use any Program content for commercial purposes, or share your access with anyone else. Your access is for you alone.

9. Access

Access to the Program and its materials is granted for the period stated at the time of purchase. We make reasonable efforts to keep materials available throughout that period, but we do not guarantee uninterrupted access and are not responsible for interruptions caused by third-party platforms, technical issues, or circumstances beyond our control.

10. Limitation of Liability

To the fullest extent permitted by law, Kimberley O'Brien is not liable for any direct, indirect, incidental, or consequential damages arising from your participation in the Program or your use of, or reliance on, any Program content. You participate at your own discretion and assume responsibility for your own choices and outcomes.

Nothing in these terms excludes or limits liability where it would be unlawful to do so.

11. Privacy

Your information is handled in accordance with our Privacy Policy, which forms part of these terms and appears below.

12. Changes to These Terms

We may update these terms from time to time. The version in effect at the time of your purchase governs that purchase. Material changes will be reflected by the "last updated" date above.

13. Governing Law

These terms are governed by the laws of the Province of Alberta and the applicable laws of Canada, and any dispute will be subject to the courts of the Province of Alberta.
